Scope

These General Terms and Conditions (GTC) apply to all deliveries made by caremare company GmbH (hereinafter referred to as the “caremare shop”) to consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

Conclusion of the Contract

The presentation of products in the online shop does not constitute a legally binding offer but merely an invitation to place an order.

By clicking the [Buy/Place order with obligation to pay] button, you submit a binding order for the goods listed on the order page. The purchase agreement is concluded when we accept your order by sending you an order confirmation by email immediately after receiving your order.

Right of Withdrawal

If you are a consumer, meaning a natural person placing the order for a purpose that cannot be attributed to your trade, business or independent professional activity, you have a statutory right of withdrawal.

If, as a consumer, you exercise your right of withdrawal in accordance with Section 4.1, you shall bear the regular costs of returning the goods.

In all other respects, the following provisions apply to the right of withdrawal:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us [name of the trader, address and, where available, telephone number, fax number and service@caremare.net] of your decision to withdraw from this contract by means of a clear statement, for example a letter sent by post, fax or email.

You may use the attached model withdrawal form for this purpose, although this is not mandatory. You may also complete and submit the model withdrawal form or another clear statement electronically on our website at caremare.store. If you make use of this option, we will immediately send you confirmation of receipt of your withdrawal, for example by email.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of your right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us.

The reimbursement shall be made without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

We shall use the same means of payment for the reimbursement as you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us, or to [the name and address of the person authorised by us to receive the goods should be inserted here, where applicable], without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract.

The deadline is met if you send the goods before the fourteen-day period has expired.

You shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods resulting from handling them in a way that was not necessary to establish their nature, characteristics and proper functioning.

Prices and Shipping Costs

The prices stated on the product pages include statutory value-added tax and all other price components.

In addition to the prices stated, we charge a flat shipping fee of EUR 4.90 per order for deliveries within Germany. The shipping costs will be clearly displayed again on the product pages, in the shopping basket and on the order page.

When paying by cash on delivery, an additional fee of EUR 2.00 will be charged and collected by the delivery service upon delivery. No additional taxes or costs apply.

Delivery

Deliveries within Germany are made using DHL GOGREEN PLUS.

The delivery time is up to three days. Any differing delivery times will be indicated on the relevant product page.

Payment

Payment shall be made in advance.

If you select advance payment as your payment method, we will provide you with our bank details in the order confirmation and dispatch the goods after receipt of payment.

Retention of Title

The goods shall remain our property until payment has been made in full.

Dispute Resolution

The European Commission has established an online platform for the resolution of disputes. The platform serves as a contact point for the out-of-court settlement of disputes arising from contractual obligations under online purchase agreements.
