1. Scope
These General Terms and Conditions apply to all deliveries by caremare company GmbH (hereinafter "caremare shop") to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

3. Conclusion of contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

3.2 By clicking the "Buy" or "Order with obligation to pay" button, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving it.

4. Right of withdrawal

4.1 If you are a consumer (a natural person placing the order for purposes outside their trade, business or profession), you have a right of withdrawal in accordance with the statutory provisions.

4.2 If you exercise your right of withdrawal under clause 4.1, we bear the cost of returning the goods provided you return them from within Germany. If you return the goods from another country, you bear the direct cost of returning them.

4.3 In all other respects, the rules set out in the following instructions apply.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us – caremare company GmbH, Krohnskamp 3, 22301 Hamburg, Germany, phone +49 (0)40 359806410, e-mail service@caremare.com – of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also complete and submit the model withdrawal form or any other unequivocal statement electronically on our website (caremare.com/pages/widerruf-formular). If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal without delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. Return address: Wolffstore GmbH, c/o caremare, Wevelinghoven 28a, 41334 Nettetal, Germany.

We will bear the cost of returning the goods if you return them from within Germany. If you return the goods from another country, you will have to bear the direct cost of returning them.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. Prices and shipping costs

5.1 The prices stated on the product pages include statutory VAT and all other price components.

5.2 Shipping costs are charged in addition to the prices stated. The shipping costs applicable to your order are shown on the product pages, in the shopping cart and on the order page before you place your order. The following flat rates apply:

• Germany: EUR 4.90 – free of shipping charges for orders of EUR 40 or more
• Express within Germany: EUR 13.50
• Other EU countries: EUR 11.90
• Switzerland: EUR 13.90
• USA: EUR 24.90

All amounts are quoted in euros. Orders from Switzerland and the United States are billed at checkout in the local currency (CHF and USD respectively); the amount shown at checkout applies.

5.3 For deliveries to countries outside the European Union (for example Switzerland or the USA), customs duties, import turnover tax and handling fees may apply in addition. These are borne by you.

6. Delivery

6.1 We deliver to Germany, to all countries of the European Union, to Switzerland and to the USA. Deliveries within Germany are made with DHL GOGREEN PLUS. Delivery to DHL Packstation is not possible.

6.2 Following receipt of payment, the delivery time is 2–4 working days within Germany, 5–8 working days within the other EU countries and Switzerland, and 7–14 working days to the USA, depending on customs clearance. With express delivery within Germany, delivery is made on the next working day for orders received by 12:00 noon on a working day. Any deviating delivery times are stated on the relevant product page.

7. Payment

7.1 Payment is possible by credit card, PayPal, Apple Pay, Google Pay and Klarna. The payment methods shown at checkout are decisive.

7.2 For express delivery within Germany, payment is only possible by credit card or PayPal.

8. Retention of title

8.1 The goods remain our property until payment has been made in full.

9. Dispute resolution

9.1 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
